1. Introduction
These Terms govern the sale of golf carts, parts, and accessories by Exclusive Golf Carts, located at Mervin J Erlank Complex, Recreation Rd, Kimberley.
2. Products and Pricing
- Accuracy: We strive for accuracy, but errors in pricing or descriptions may occur. We reserve the right to cancel orders arising from such errors.
- VAT: All prices include 15% South African VAT unless otherwise stated.
- Availability: All stock is subject to availability. Custom builds require specific lead times.
3. Orders and Payments
- Payment Methods: We accept EFT and secure online payments via approved gateways.
- Quotes: Formal quotes are valid for 7-14 days due to currency and stock fluctuations.
- Ownership: Goods remain the property of Exclusive Golf Carts until paid for in full.
4. Shipping and Delivery
- Nationwide Delivery: We deliver across South Africa. Costs are calculated based on the delivery address and cart size.
- Risk: Risk passes to the customer once the vehicle is offloaded at the delivery site.
5. Trade-In Policy
- Valuations: Any trade-in value offered is subject to a physical inspection of your current cart.
- Ownership: You must prove legal ownership of any vehicle traded in.
6. Warranty and Repairs
- New Carts: Subject to the manufacturer’s specific warranty terms.
- Pre-owned Carts: Sold with a limited dealer warranty (details provided at the time of sale) or “as-is” where disclosed, in line with the CPA.
- Exclusions: Warranties do not cover wear and tear, battery neglect, or unauthorized modifications.
7. Cancellations and Returns (ECTA Compliance)
- Cooling-off: For online purchases, you have 7 days after receiving the goods to cancel the transaction.
- Condition: Returns are only accepted if the cart is in its original, unused condition.
- Refunds: Refunds are processed within 30 days, less any direct costs for returning the goods.
8. Limitation of Liability
Exclusive Golf Carts is not liable for any indirect or consequential loss arising from the use of our products or website. Use of golf carts on public roads must comply with local municipal bylaws.
9. Governing Law
These terms are governed by the laws of the Republic of South Africa.
